Everybody needs a will, regardless of wealth.  Without a will the government has full control of where property goes and who handles an elder's affairs. 

 

The American Indian Probate Reform Act dictates testate and intestate estates, and it is complex.  An estate plan allows elders to decide where their trust and non-trust property should go and greatly aids those who rely on an interest in trust or restricted property.  Furthermore, having a will can prevent further fractionation of trust land.

But is it too Expensive?
 
Even though elder estate plan services are sorely needed, most tribes cannot afford to hire an attorney to provide these services.  However, we have found a way to take advantage of inexpensive technology to make our services available to all tribes. 
 
Because we are able to meet with elders via video conference and we provide part-time services, the cost to your tribe is reasonable; in fact it is a bargain compared to the usual costs involved.

How it Works

 

We conference with elders once weekly via online video (or in-person depending on location).

 

We work closely with the Tribal Court or other administrative office to schedule follow-up consultations and final signing. 

 

We contract with the Tribal Business Committee or other similar regulatory body for payment.
